Terms of Service
Version 1 · effective September 3, 2026
Terms of Service
These terms are the agreement between you and Realty Studios, split into parts because we do two different things: Part A applies if you book photography or listing media from us, Part B if you are a photography studio subscribing to our software, and Part C to everyone. The short version: we shoot and deliver the media you order and invoice you for it; we keep the copyright in the images and licence them to you for marketing the specific property you booked; subscribing studios keep ownership of their own data and can export it; we do not give real-estate, appraisal or legal advice; and British Columbia law governs any dispute.
Effective date: September 3, 2026.
Who we are
Realty Studios is the operating name of VLGRS Inc., incorporated federally in Canada under the Canada Business Corporations Act and operating in British Columbia, Canada. Reach us at info@realtystudios.ca or +1 (604) 779-4089. In these terms, "we", "us" and "Realty Studios" mean VLGRS Inc.; "you" means the person or business using our services.
Accepting these terms
You accept these terms when you book a shoot, sign up a studio account, or otherwise use our websites and applications. These terms govern your use of our websites, our software and the services you order. For shoots, the Booking, Delivery and Cancellation Policy is the document linked from checkout and it governs booking, payment, measured area and delivery; our Refund Policy explains rescheduling, reshoots and refunds; our Privacy Policy explains what we do with personal information. Read those alongside these terms. If you are agreeing on behalf of a brokerage or company, you confirm you may bind it. If you do not accept these terms, do not book a shoot and do not use the software.
Part A — Photography and listing-media services
Booking and payment
The booking flow at /book shows what you are ordering and what it costs before you commit. Payment terms, taxes, how a slot is confirmed, how measured area affects your invoice and how delivery works are set out on the Booking, Delivery and Cancellation Policy page, which is linked from checkout and forms part of this agreement. Read it before you book; if it conflicts with a general statement in these terms about booking, delivery or payment, that page governs.
Prices are in Canadian dollars and shown before tax; GST is added and itemised, and other applicable taxes are added where they apply. You are responsible for the invoice for the shoot you booked, including where you booked on behalf of another agent or a seller and asked us to address the invoice elsewhere. Rescheduling, cancellation and refunds are covered in our Refund Policy.
Delivery
We tell you by email when your files are ready to download. Where a service has a published delivery timeline, it is shown in the booking flow and on your order confirmation. These terms promise no fixed turnaround: the timeline shown for that order, if one is shown, is the one that applies. Where an order is unpaid, we may make previews available and hold back the full-resolution files until the invoice is settled.
Who owns the photos, and what you may do with them
We keep the copyright in the photographs, video, floor plans and other media we produce. You are not buying the copyright; you are buying a licence to use the files.
When you book a shoot, you receive a licence to use the delivered files to market the specific property you booked — the MLS and real-estate portals, your own website and social media, and print and email marketing for that property. Your co-listing agent and your brokerage may use the files for that same listing on the same basis.
The licence does not extend to a different property, to resale or sublicensing, or to use by a third party who was not part of the listing. Please do not remove or alter any credit or metadata we include.
Where we sell a homeowner a personal-use licence to their own property's images, it is for personal, non-commercial use only — prints, family records, personal social posts. The photographer retains copyright, and the licence does not permit resale, real-estate marketing of another listing, or commercial publication.
Your responsibilities on the day
Please make sure the property is accessible and shoot-ready at the scheduled time and that anyone who must authorise the shoot has done so. You confirm you have the right to have the property photographed and to give us the access and information you give us. If something on our end affects the quality of your deliverables, contact us and we will make it right — see the Refund Policy.
Part B — The Realty Studios software
Part B applies to photography studios that sign up at /signup and run their own bookings, customers and portal on our platform. What the software does is described at /for-studios.
Your account
You are responsible for your credentials, for the people you invite into your workspace and for what they do there. Tell us promptly if you think an account has been compromised, and keep your contact details current — we use them for service notices.
Subscription and fees
Plans and what each includes are shown on the pricing page. Fees are as shown on that page in the currency displayed there when you subscribe, plus applicable taxes, billed in advance for the period you choose, and are not refundable for a period already begun except where our Refund Policy or applicable consumer-protection law says otherwise. If a payment fails or is late we may pause access to paid features until it is settled. On a free tier we may display a "Powered by Lakme Media" credit on that tier's public surfaces. We may change plan pricing; a change takes effect at your next renewal, on the notice described under "Changes to these terms".
Your data, and our role
Your media and your customer data belong to you. We process them on your behalf to deliver the service, under your instructions and under our Privacy Policy.
For personal information about your own customers, you are the organisation accountable to them and we act as your service provider. You are responsible for having a lawful basis to collect it, for your own privacy policy, for honouring your customers' privacy and unsubscribe requests, and for the content you upload — including having the right to upload it.
While your subscription is active you can export your orders, customers and invoices from the admin area. Exports are limited to owner and administrator roles and are recorded in an audit log.
Acceptable use of the software
Do not use the platform to send unlawful or unsolicited commercial messages, to upload content you have no right to upload, to store card data outside the payment processor, to reach another studio's data, to probe or interfere with the service's security, to scrape it, or to resell access as your own product without our agreement. We may suspend an account that abuses the service or puts other customers at risk, and we will tell you why.
Ending your subscription
You may cancel at any time from your account settings. Cancellation takes effect at the end of the current paid period: access continues until then and we do not delete your data at the moment you cancel, so export what you need before it ends. We may suspend or terminate an account for material breach, for non-payment, or where the law requires it.
Part C — Terms that apply to everyone
AI-assisted features
Some features use third-party artificial-intelligence providers to generate or analyse content — drafting text, summarising, checking uploaded images. When you use one, the text or images that feature sends are transmitted to the provider for processing; our current providers are named in our Privacy Policy.
AI output can be wrong, incomplete or unsuitable. It is a starting point, not a finished professional product. Check anything you intend to publish, do not rely on it for legal, financial or regulatory statements, and remember you remain responsible for what you publish from your account.
Acceptable use of our sites
Do not misuse our public websites, forms or endpoints: no automated abuse, no attempts to reach accounts or data that are not yours, no interference with the service, nothing unlawful. We rate-limit public endpoints and may block traffic that abuses them.
Availability
We aim for high availability but cannot guarantee uninterrupted access — maintenance, third-party outages and events outside our control can interrupt the service. We offer no service-level guarantee, and nothing here should be read as one.
What we are not
We are not real estate agents, brokers, or licensed appraisers. The media we produce is marketing material, not a legal representation of a property's condition, size, boundaries or value. Floor plans and measurements are prepared for marketing and are approximate; anyone relying on them for a transaction should verify them independently. Nothing we provide is legal, financial, tax or appraisal advice.
Limitation of liability
The service is provided "as is" and "as available". To the fullest extent the law permits, we exclude implied warranties and conditions and are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, business or data. Our total liability for all claims arising out of or relating to this agreement is limited to what you paid us in the twelve months before the event giving rise to the claim.
Nothing here limits liability that cannot be limited by law — including for fraud, fraudulent misrepresentation, or personal injury or death caused by negligence — or takes away rights you have under British Columbia consumer-protection law that cannot be waived.
Changes to these terms
We may update these terms; the effective date above tells you which version you are reading. Material changes are posted in the application and emailed to active accounts at least 14 days before they take effect. Using the service after that date means you accept them; if you do not, stop using the service and, for a subscription, cancel before the change takes effect.
Governing law and disputes
These terms are governed by the laws of British Columbia and the federal laws of Canada that apply there, without regard to conflict-of-laws rules. You and we agree to the exclusive jurisdiction of the courts of British Columbia sitting in Vancouver, subject to any right you have as a consumer to bring a claim where you live. Before starting a formal proceeding, please email info@realtystudios.ca and give us a real chance to fix the problem.
General
If any provision is found unenforceable, the rest stays in force, and not enforcing a term on one occasion does not waive it. You may not assign this agreement without our consent; we may assign it as part of a sale or reorganisation of our business. These terms, with the policies they reference, are the entire agreement between us about the service, and are drawn up in English at the parties' request.
